These Service Provider Terms & Conditions ("Terms") govern your use of MH20 Online Services / Formswala and its related technology-enabled B2B service facilitation and application-processing platform ("Formswala" or "Platform").

By registering for, accessing, or using the Platform, and specifically by clicking "I Accept & Continue", you confirm that you have read, understood and agreed to these Terms and agree to comply with them.

If you do not agree with these Terms, you must not continue to use the Platform or its Service Provider facilities.

1. Formswala's Authorized Processing Role

Formswala operates as an authorized portal/service-processing platform for Government services and Government portal processes for which Formswala has applicable authorization, appointment, access or other lawful permission.

Where a Service Provider uses Formswala for an eligible Government service, the Service Provider may collect the required customer information and supporting documents and provide them to Formswala through the Platform or through the applicable authorized process.

Formswala may, on behalf of the Service Provider and for the purpose of processing the relevant service request, receive the information and documents supplied by the Service Provider, prepare or process the applicable application, enter or upload relevant information, and submit or process the application through the applicable authorized Government portal/system or other authorized channel.

How the Service Process Works

1. The Service Provider obtains the required customer information and documents.
2. The Service Provider submits/provides the required information and documents to Formswala.
3. Formswala receives and processes the application information and documents for the applicable service.
4. Formswala processes/submits the application through the applicable authorized Government portal/system or authorized process.
5. The application remains subject to the requirements, scrutiny, verification and decision of the applicable Government authority.

2. Nature of the Service Provider Relationship

The Service Provider uses Formswala as a processing and facilitation platform for eligible services.

Unless separately agreed in writing, the Service Provider is not an employee, officer or Government official merely because the Service Provider uses Formswala.

The Service Provider must not represent that use of Formswala gives the Service Provider independent Government authority, Government decision-making power or a guaranteed Government outcome.

3. Documents & Information Submitted to Formswala

The Service Provider is responsible for collecting the required customer information and documents and submitting accurate, complete and genuine information to Formswala.

Formswala may process the information and documents supplied by the Service Provider for the purpose of the requested service.

If the information or documents supplied are incomplete, inaccurate, inconsistent, expired, illegible, unverifiable or otherwise insufficient, Formswala may request clarification, additional documents or corrections before processing or submission.

The Service Provider must not knowingly provide Formswala with forged, fabricated, altered, misleading or false information or documents.

4. Formswala Processing & Submission

After receiving the required information and documents from the Service Provider, Formswala may process the application in accordance with the applicable service requirements and the procedures of the relevant Government portal/system.

Processing may include:

• Data entry
• Document review for processing purposes
• Formatting
• Uploading
• Application preparation
• Submission
• Tracking
• Status updates
• Related administrative or technical activities

5. Government Service & Final Decision

Formswala may be authorized to process or submit eligible applications through the applicable Government portal/system, but the final decision regarding approval, rejection, objection, verification, appointment, certificate issuance, licence issuance, registration or any other Government outcome remains with the applicable competent Government authority.

6. Government Fees & Formswala Platform Fee

Government/official fees payable for a Government service and the Formswala platform, processing or facilitation fee are separate charges.

The Formswala platform fee is charged to the Service Provider for Formswala's platform and processing/facilitation services and is not automatically a Government fee.

The Service Provider must not falsely represent Formswala's platform fee, processing fee or service charge as a Government fee.

7. Service Provider Payment Obligation

Where a Formswala platform, processing or facilitation fee is applicable, the Service Provider agrees to pay the applicable Formswala fee in accordance with the applicable pricing, wallet, billing, invoice or payment arrangement communicated through the Platform.

Formswala may require payment or sufficient wallet/account balance before processing, submission or completion of an applicable service, where such payment condition applies.

8. No Guarantee of Government Outcome

The Service Provider must not guarantee Government approval, certificate issuance, licence issuance, registration, appointment, rejection-free processing, a particular Government decision, processing time or any other outcome that is outside Formswala's control.

Formswala's role in processing or submitting an application does not mean that the application will necessarily be approved by the Government authority.

9. Prohibited Customer Commitments & Misrepresentation

The Service Provider must not make false, misleading, deceptive or unauthorized statements to any customer regarding Formswala, Government authorities, Government procedures, fees, processing times or Government outcomes.

Examples of prohibited commitments include:

• "100% approval guaranteed."
• "Certificate pakka milega."
• "Reject nahi hoga."
• "Government officer se setting hai."
• "Officer ko hum manage kar lenge."
• "Government approval guaranteed hai."
• "Extra payment karo, approval guaranteed hai."
• Claiming that Government approval has already been issued when no such official approval exists.
• Claiming that Formswala can guarantee or force a Government decision.
• Claiming special influence over a Government officer or department without lawful authority.

10. Unauthorized Representation of Formswala

The Service Provider must not represent or imply that the Service Provider is an employee, officer, partner, legal representative or authorized Government representative of Formswala unless such status has been expressly granted in writing.

The Service Provider must not use Formswala's name, logo, branding, documents, communications or materials to create a false impression of Government authority, special Government access or guaranteed Government results.

11. Customer Communication

The Service Provider must communicate honestly and professionally with customers and accurately explain the nature of the service, required documents, applicable Government fees, Formswala charges, Service Provider charges, processing status and Government decision process.

Where a result depends upon Government verification, approval or another third party, the Service Provider must communicate that fact clearly and must not present the result as certain.

12. Customer Consent & Authorization

Before submitting customer information or documents to Formswala, the Service Provider must obtain the customer's appropriate consent, authorization or instruction where required for the relevant service and applicable law.

13. Customer Data & Document Protection

The Service Provider must protect customer information and documents from unauthorized access, disclosure, misuse, alteration, loss or unnecessary sharing.

Customer information provided to Formswala may be processed by Formswala for the purpose of the requested service, application processing, submission, tracking, support, compliance, audit and related legitimate operational purposes, subject to applicable law and applicable privacy/data-handling practices.

14. Accuracy & Verification of Documents

The Service Provider must provide accurate customer information and genuine documents to Formswala.

The Service Provider must not knowingly provide forged, fabricated, altered, manipulated, misleading, expired or false documents where such documents are not legitimately acceptable for the relevant service.

15. Fraudulent, Illegal & Unauthorized Activities

The Platform must not be used for fraud, impersonation, deception, fabrication of information, forged documentation, unauthorized access, manipulation of Government systems, submission of knowingly false applications, circumvention of security controls or any other unlawful activity.

16. Government Portal & Third-Party Dependencies

Formswala's processing may depend upon the availability and operation of Government portals, Government systems, APIs, verification services, payment systems, communication providers, internet connectivity and other third-party systems.

Government portal downtime, maintenance, technical problems, verification delays, system errors, policy changes, changes in Government procedures or other events outside Formswala's reasonable control may delay or affect processing.

17. Processing Time

Any processing time displayed or communicated through Formswala should be treated as an indicative processing period unless expressly stated otherwise.

Government scrutiny, verification, appointment availability, objections, additional document requirements and technical or administrative delays may extend processing time.

18. Customer Payments, Refunds & Cancellation

The Service Provider must communicate applicable charges and payment conditions accurately to customers.

A Government fee, once paid to or processed by the relevant authority, may be subject to the refund and cancellation rules of that authority.

Formswala platform or processing fees may be subject to applicable refund and cancellation rules communicated by Formswala. Where processing work has already been performed, the Formswala fee may not automatically become refundable merely because a Government authority subsequently rejects, delays or does not process an application.

19. Service Provider Charges to Customers

Where the Service Provider independently charges a customer for its own assistance, professional service, consultation, documentation support or other lawful service, that charge is separate from the Formswala platform/processing fee and any Government fee.

20. Account Security

Platform credentials are personal to the registered Service Provider and must not be shared, sold, transferred, rented or provided to unauthorized persons.

The Service Provider is responsible for maintaining the confidentiality of login credentials and for promptly reporting suspected unauthorized access or account compromise.

21. Account Suspension / Restriction / Termination

Formswala may suspend, restrict, investigate or terminate Platform access where it reasonably suspects or identifies fraud, false commitments, customer deception, unauthorized representation, document misuse, credential misuse, security risks, unlawful activity or material violation of these Terms.

22. Investigation & Records

Formswala may maintain operational, transaction, security, processing and acceptance records relating to Platform use for legitimate business, security, compliance, dispute-resolution and audit purposes, subject to applicable law.

23. Indemnity & Service Provider Responsibility

To the extent permitted by applicable law, the Service Provider agrees to be responsible for losses, claims, complaints, penalties, damages, liabilities, costs or expenses arising from the Service Provider's own fraud, negligence, misconduct, unauthorized representation, false customer commitments, misuse of customer information, submission of false information or documents, violation of these Terms or unlawful activity.

24. Limitation of Platform Responsibility

Formswala's responsibility is limited to the services and processing activities it actually undertakes within the applicable authorized workflow.

Formswala does not control Government decisions, Government processing times, Government scrutiny, Government verification, third-party portal availability, third-party payment systems or other matters outside its reasonable control.

25. Confidentiality

The Service Provider must keep confidential any non-public business, technical, customer, operational, pricing, account or Platform information obtained through Formswala and must not disclose such information to unauthorized persons.

26. Intellectual Property & Platform Materials

The Platform, software, interface, branding, logos, design, text, workflows, documentation and other Formswala materials may be protected by applicable intellectual property laws and rights.

Except where expressly permitted, the Service Provider must not copy, reproduce, sell, sublicense, reverse engineer, redistribute or misuse Formswala software, branding or proprietary materials.

27. Changes to Services & Government Procedures

Government requirements, fees, forms, procedures, portals and processing rules may change from time to time.

Formswala may update Platform workflows, service information, processing procedures and functionality to reflect operational, technical or regulatory changes.

28. Updates to These Terms

Formswala may update these Terms from time to time. Each updated version may be identified by a new version number and/or effective date.

29. Electronic Acceptance & Consent Record

By selecting the checkbox and clicking "I Accept & Continue", the logged-in Service Provider confirms acceptance of the Terms displayed for the applicable Terms version.

Formswala may maintain an electronic record of the acceptance, including the account identity, user name, tenant/account context, Terms version, acceptance date and time, IP address and browser/device user-agent, subject to applicable law and applicable privacy and data-handling practices.

30. No Transfer of Government Authority

The fact that Formswala may have authorized access, authorization, appointment or permission for particular Government services does not transfer Government statutory powers or decision-making authority to the Service Provider.

31. Compliance with Applicable Law

The Service Provider agrees to use Formswala in compliance with applicable laws, regulations, Government procedures and lawful instructions relevant to the services being provided.

32. Governing Law & Jurisdiction

These Terms are intended to be governed by the applicable laws of India, subject to mandatory provisions of applicable law.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable to the extent prohibited by applicable law, the remaining provisions will continue to operate to the extent legally permissible.

34. Entire Service Provider Understanding

These Terms, together with any applicable Platform policies, service rules, pricing information, privacy provisions and other expressly incorporated terms, govern the Service Provider's use of Formswala and the Platform to the extent applicable.
