1. Separate Types of Charges

Charges associated with a service may include different components:

• Government Fee: Any official fee, statutory fee or other amount payable to the relevant Government authority or Government portal for the applicable service.
• Formswala Platform / Processing Fee: The fee charged by Formswala to the Service Provider for providing the platform, processing, application facilitation, technical workflow and/or related services.
• Service Provider Charges: Any separate amount that the Service Provider lawfully charges its own customer for its own services.

2. Government Fees

Government fees payable for a Government service are separate from the Formswala platform, processing or facilitation fee.

A Government fee, once paid to or processed by the relevant Government authority, may be subject to the refund and cancellation rules of that authority.

3. Formswala Platform & Processing Fees

Formswala platform or processing fees may be subject to applicable refund and cancellation rules communicated by Formswala.

These fees relate to Formswala's platform, processing/facilitation services, technical workflow and related activities.

4. Processing Work Already Performed

Where processing work has already been performed, the Formswala fee may not automatically become refundable merely because a Government authority subsequently rejects, delays or does not process an application.

Government scrutiny, verification, objections, additional document requirements, technical problems and other circumstances outside Formswala's reasonable control may affect the outcome or processing time.

5. Cancellation

Applicable cancellation treatment may depend on the type of charge and the stage of processing.

Government fees may be governed by the cancellation rules of the relevant Government authority.

Formswala platform or processing fees may be governed by the applicable refund and cancellation rules communicated by Formswala.

6. Service Provider Charges

Where a Service Provider independently charges a customer for assistance, professional service, consultation, documentation support or another lawful service, that charge is separate from both the Formswala platform/ processing fee and any Government fee.

The Service Provider is responsible for communicating its own charges honestly and for complying with applicable laws and requirements.

7. Accurate Communication of Charges

Service Providers must communicate applicable charges and payment conditions accurately to customers.

Government fees, Formswala fees and Service Provider charges must not be combined, disguised or misrepresented in a way that is misleading to the customer.

8. No Refund Based Solely on Government Outcome

Formswala's role in processing or submitting an application does not mean that the application will necessarily be approved by the Government authority.

Therefore, a subsequent Government rejection, delay or failure to process an application does not automatically make a Formswala processing fee refundable where processing work has already been performed.
